These Terms of Service (the “Terms”) govern your use of transilvaniashop.com (the “Site”) and purchases made through Transilvania Shop. The Site is operated by Dede Wide World S.R.L, with its registered address at Strada Stadionului 171, Mediaș, Sibiu County, 551105, Romania. References to “we,” “us,” and “our” mean Dede Wide World S.R.L.
By accessing the Site, creating an account, submitting content, or placing an order, you agree to these Terms. If you do not agree, do not use the Site. Mandatory rights granted to consumers by applicable law are not limited by these Terms.
1. Eligibility and Customer Accounts
You must have legal capacity to enter into a contract or use the Site with the authorization of a parent or legal guardian. The Site is not directed to children under 16.
When creating an account or placing an order, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account. Notify us promptly if you suspect unauthorized access.
2. Products and Product Information
We make reasonable efforts to present product descriptions, specifications, dimensions, colors, photographs, availability, and prices accurately. Screen settings, lighting, manufacturing tolerances, and supplier updates may cause minor differences. Such differences do not affect any mandatory right you may have when goods are defective or not as described.
Products may be fulfilled and shipped directly by carefully selected third-party suppliers or logistics partners. While we strive to ensure consistent quality and accurate product information, minor variations in packaging, labeling, presentation, or manufacturer branding may occur without affecting the product’s intended functionality or your statutory consumer rights. Availability may change without notice. We may limit quantities, discontinue products, or correct genuine errors, subject to applicable consumer law.
3. Orders and Contract Formation
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we confirm fulfillment or dispatch, unless applicable law provides otherwise.
Once an order has entered the fulfillment process with one of our suppliers, changes or cancellations may no longer be possible. Please contact us immediately if you need to modify your order.
We may reject or cancel an order for legitimate reasons, including unavailability, an obvious pricing or description error, suspected fraud, payment failure, legal restrictions, or inability to deliver. If payment has already been collected for a cancelled order, we will issue a refund using the original payment method.
4. Prices, Taxes, and Payment
Prices are displayed in the currency selected for your market or converted through the Site. The final price, shipping charge, applicable taxes, and total payable amount are shown at checkout before you submit the order.
Payments are processed by third-party payment providers. You authorize the applicable provider to charge the selected payment method. We do not generally receive or store complete payment-card details.
5. Shipping and Delivery
Available destinations, shipping charges, estimated delivery times, and any free-shipping threshold are displayed on the Site or at checkout. Delivery times are estimates unless expressly stated otherwise and may be affected by destination, carrier operations, customs, supplier processing, weather, or other circumstances outside our reasonable control.
Some products may be shipped from different fulfillment locations depending on stock availability and the destination country. If an order contains multiple products, they may arrive separately.
If we cannot ship within the advertised period, we will provide any notice, cancellation option, consent request, or refund required by applicable law. For United States orders, where the FTC Mail, Internet, or Telephone Order Merchandise Rule applies, we will seek consent to a material delay or provide a prompt refund as required.
You are responsible for providing an accurate and complete delivery address. Contact us promptly if you identify an error. We cannot guarantee that an address can be changed after fulfillment begins.
6. Returns, Withdrawal, Refunds, and Legal Guarantees
Returns and refunds are governed by our Refund and Return Policy, which forms part of these Terms.
Consumers in the EU/EEA have a statutory 14-day right of withdrawal for most distance purchases, subject to legal exceptions. We also offer the voluntary 30-day return period described in that Policy.
EU consumers also benefit from the mandatory legal guarantee for goods that are faulty or not as described. Nothing in these Terms replaces or reduces any mandatory consumer guarantee, warranty, remedy, or cancellation right.
7. Reviews and User Content
You may submit reviews, ratings, photographs, or other content. We do not edit customer reviews in a way that changes their meaning, although we may remove content that violates these Terms or applicable law.
You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and use it for operating and promoting the Site and products, for as long as the content remains published.
Content must be truthful, based on genuine experience where represented as a customer review, and must not infringe rights, reveal another person’s private information, contain malware, or be unlawful, discriminatory, threatening, defamatory, obscene, or misleading. We may moderate or remove content where reasonably necessary, but we are not obligated to publish every submission.
8. Acceptable Use
You may not use the Site to violate law, infringe intellectual-property or privacy rights, impersonate another person, submit fraudulent orders, scrape or harvest data without authorization, introduce malicious code, interfere with security, conduct abusive activity, or attempt unauthorized access. We may restrict access where reasonably necessary to protect the Site, customers, or legal rights.
9. Intellectual Property
The Site, branding, layout, original text, graphics, and other content owned by or licensed to us are protected by applicable intellectual-property laws. You may use the Site only for personal, non-commercial shopping purposes. No license is granted except as expressly stated.
10. Third-Party Services and Links
The Site may use or link to services operated by Shopify, payment providers, review providers, advertising platforms, third-party fulfillment suppliers, carriers, and other third parties. Their services may be governed by separate terms and privacy notices. We are not responsible for independent third-party websites, but this does not limit our responsibility to you as the seller where mandatory consumer law applies.
11. Privacy
Our collection and use of personal information is described in the Transilvania Shop Privacy Policy. Cookie and advertising preferences can be managed through the Site’s privacy controls where available.
12. Disclaimer and Limitation of Liability
We do not guarantee that the Site will always be uninterrupted or error-free. To the maximum extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.
Nothing in these Terms excludes or limits liability where exclusion is prohibited, including liability for fraud, willful misconduct, death or personal injury caused by negligence where applicable, or liability arising from mandatory consumer-protection rights. If you are a consumer, your statutory remedies remain unaffected.
13. Suspension and Termination
You may stop using the Site or close your account at any time. We may suspend or terminate access for a material breach, fraud, abuse, security risk, or legal requirement. Provisions that by their nature should survive termination remain effective.
14. Governing Law and Disputes
These Terms are governed by Romanian law. If you are a consumer resident in another country, this choice does not deprive you of mandatory protections provided by the law of your habitual residence.
Disputes may be submitted to the competent courts under applicable law. EU consumers may also seek assistance from the European Consumer Centre in their country where available. We encourage you to contact us first so that we can attempt to resolve the matter.
15. Changes to These Terms
We may update these Terms to reflect legal, operational, technical, or business changes. The revised version will be posted on the Site with an updated date. Changes will not retroactively reduce rights connected with an order already accepted, unless required by law or agreed with you.
16. Severability and Entire Agreement
If any provision is held invalid or unenforceable, the remaining provisions remain effective. These Terms and the policies expressly incorporated into them form the agreement governing your use of the Site and purchases, without limiting mandatory legal rights.
